<title>Obama To Make Good On Closing Down Guantanamo: Plans Detainee Trials</title>
<description>&lt;p&gt;WASHINGTON &amp;mdash; President-elect Obama's advisers are quietly crafting a proposal to ship dozens, if not hundreds, of imprisoned terrorism suspects to the United States to face criminal trials, a plan that would make good on his promise to close the Guantanamo Bay prison but could require creation of a controversial new system of justice.&lt;/p&gt;

&lt;p&gt;During his campaign, Obama described Guantanamo as a "sad chapter in American history" and has said generally that the U.S. legal system is equipped to handle the detainees. But he has offered few details on what he planned to do once the facility is closed.&lt;/p&gt;
        &lt;p&gt;Under plans being put together in Obama's camp, some detainees would be released and many others would be prosecuted in U.S. criminal courts.&lt;/p&gt;

&lt;p&gt;A third group of detainees _ the ones whose cases are most entangled in highly classified information _ might have to go before a new court designed especially to handle sensitive national security cases, according to advisers and Democrats involved in the talks. Advisers participating directly in the planning spoke on condition of anonymity because the plans aren't final.&lt;/p&gt;

&lt;p&gt;The move would be a sharp deviation from the Bush administration, which established military tribunals to prosecute detainees at the Navy base in Cuba and strongly opposes bringing prisoners to the United States. Obama's Republican challenger, John McCain, had also pledged to close Guantanamo. But McCain opposed criminal trials, saying the Bush administration's tribunals should continue on U.S. soil.&lt;/p&gt;

&lt;p&gt;The plan being developed by Obama's team has been championed by legal scholars from both political parties. But it is almost certain to face opposition from Republicans who oppose bringing terrorism suspects to the U.S. and from Democrats who oppose creating a new court system with fewer rights for detainees.&lt;/p&gt;

&lt;p&gt;Laurence Tribe, a Harvard law professor and Obama legal adviser, said discussions about plans for Guantanamo had been "theoretical" before the election but would quickly become very focused because closing the prison is a top priority. Bringing the detainees to the United States will be controversial, he said, but could be accomplished.&lt;/p&gt;

&lt;p&gt;"I think the answer is going to be, they can be as securely guarded on U.S. soil as anywhere else," Tribe said. "We can't put people in a dungeon forever without processing whether they deserve to be there."&lt;/p&gt;

&lt;p&gt;The tougher challenge will be allaying fears by Democrats who believe the Bush administration's military commissions were a farce and dislike the idea of giving detainees anything less than the full constitutional rights normally enjoyed by everyone on U.S. soil.&lt;/p&gt;

&lt;p&gt;"There would be concern about establishing a completely new system," said Rep. Adam Schiff, D-Calif., a member of the House Judiciary Committee and former federal prosecutor who is aware of the discussions in the Obama camp. "And in the sense that establishing a regimen of detention that includes American citizens and foreign nationals that takes place on U.S. soil and departs from the criminal justice system _ trying to establish that would be very difficult."&lt;/p&gt;

&lt;p&gt;Obama has said the civilian and military court-martial systems provide "a framework for dealing with the terrorists," and Tribe said the administration would look to those venues before creating a new legal system. But discussions of what a new system would look like have already started.&lt;/p&gt;

&lt;p&gt;"It would have to be some sort of hybrid that involves military commissions that actually administer justice rather than just serve as kangaroo courts," Tribe said. "It will have to both be and appear to be fundamentally fair in light of the circumstances. I think people are going to give an Obama administration the benefit of the doubt in that regard."&lt;/p&gt;

&lt;p&gt;Though a hybrid court may be unpopular, other advisers and Democrats involved in the Guantanamo Bay discussions say Obama has few other options.&lt;/p&gt;

&lt;p&gt;Prosecuting all detainees in federal courts raises a host of problems. Evidence gathered through military interrogation or from intelligence sources might be thrown out. Defendants would have the right to confront witnesses, meaning undercover CIA officers or terrorist turncoats might have to take the stand, jeopardizing their cover and revealing classified intelligence tactics.&lt;/p&gt;

&lt;p&gt;In theory, Obama could try to transplant the Bush administration's military commission system from Guantanamo Bay to a U.S. prison. But Tribe said, and other advisers agreed, that was "a nonstarter." With lax evidence rules and intense secrecy, the military commissions have been criticized by human rights groups, defense attorneys and even some military prosecutors who quit the process in protest.&lt;/p&gt;

&lt;p&gt;"I don't think we need to completely reinvent the wheel, but we need a better tribunal process that is more transparent," Schiff said.&lt;/p&gt;

&lt;p&gt;That means something different would need to be done if detainees couldn't be released or prosecuted in traditional courts. Exactly what that something would look like remains unclear.&lt;/p&gt;

&lt;p&gt;According to three advisers participating in the process, Obama is expected to propose a new court system, appointing a committee to decide how such a court would operate. Some detainees likely would be returned to the countries where they were first captured for further detention or rehabilitation. The rest could probably be prosecuted in U.S. criminal courts, one adviser said. All spoke on condition of anonymity to discuss the ongoing talks, which have been private.&lt;/p&gt;

&lt;p&gt;Whatever form it takes, Tribe said he expects Obama to move quickly.&lt;/p&gt;

&lt;p&gt;"In reality and symbolically, the idea that we have people in legal black holes is an extremely serious black mark," Tribe said. "It has to be dealt with."&lt;/p&gt;

<title>Changing the World Involves Being Good Winners</title>
<description>&lt;p&gt;   
 &lt;/p&gt;&lt;p&gt;A few lines that came in an email today:&lt;/p&gt;

&lt;p&gt;"Try to be kind to each other. Do not radiate triumphalism or entitlement or disparagement or distaste. Do not gloat. Help your neighbor quietly, and speak encouragingly of all efforts to make things better.  Take your lead from Obama and be respectful, gracious, understanding, and aware that at this time both joy and resentment are hateful to many, Do not presume. Celebrate quietly for what has been gained.  Mourn quietly for what has been lost and what may yet be lost.  Nothing is guaranteed or certain.  Try to be the people we would want our conquerors to be."&lt;/p&gt;

&lt;p&gt;I couldn't agree more. The best victories are those that change a power balance, but leave relationships between the adversaries that can be healed. Here in the U.S., there's a lot of bad blood between conservatives and progressives, but if we want to see change, we'll need those conservatives to at least agree that change is something they can accept, and they're much more likely to do that if dealt with respectfully and graciously.&lt;/p&gt;

&lt;p&gt;Which is not to say that people should not be held accountable for their crimes and misdeeds over the last eight years. They should. People should go to jail. Nonviolence does not mean ignoring criminality and wrongdoing. &lt;/p&gt;

&lt;p&gt;But the Bush administration and the Rovian Far Right don't make up the majority of the Republican Party, or even conservatives: the vast majority of American conservatives are decent people who want good to triumph in the world, and we need to win their support, or at least their consent, if we're going to transform the world.&lt;/p&gt;

&lt;p&gt;Let's do this with some class.&lt;/p&gt;

&lt;p&gt;It&amp;#8217;s still several hours before any results pour in for the U.S. presidential election, but that hasn&amp;#8217;t stopped editorial cartoonists from making predictions and readying their submissions. Daryl Cagle&amp;#8217;s online hub of editorial cartoons has already started compiling &lt;a href="http://cagle.com/news/ObamaWins08/main.asp"&gt;cartoons depicting Obama&amp;#8217;s victory&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;MAD cartoonist Tom Richmond also recently posted a look at MAD&amp;#8217;s efforts to not predict election results, but to &lt;a href="http://www.tomrichmond.com/blog/?p=3259"&gt;prepare two versions of features or cover art&lt;/a&gt; that feature a winning presidential candidate.&lt;/p&gt;

Obama's crowd in Grant Park looks like America, at least the America I see everyday. &lt;I&gt;It's diverse&lt;/i&gt;. Compare that with the portrait of America gathered in Arizona. I think that says volumes about one factor that made this Obama victory possible. &lt;br /&gt;&lt;br /&gt;&lt;ul&gt;"In the last two presidential elections, the American people divided down the middle, producing a both a geographical and a demographic divide that seemed increasingly set in stone. Blue Democratic America consisted of the west and the east coasts plus the upper Midwest. Red Republican America covered the swaths in between. Women, minorities, the poor and the highly educated voted Democratic. Men, white people, the rich and the religious delivered for the Republicans. In the mind of Mr Bush's strategist Karl Rove this division was the template of 21st century American politics, a base for a conservative counter-attack against 20th-century liberalism.&lt;br /&gt;&lt;br /&gt;Rove's America was not just turned on its head yesterday. It was broken up and recast in a very different mould. One of Mr Obama's many achievements has been his refusal to accept the permanence of the blue-red divide. Hello to whatever new mud-slinging the next political cycle brings.&lt;br /&gt;&lt;br /&gt;So long to the idea that a Black person can't be President in our lifetime. Hello to crazy talk that "racism is over in America."&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Hello to the millions who waited in line to cast a ballot today.&lt;br /&gt;&lt;br /&gt;Hello to those who waited their entire lives. And their parents' lives. <title>ON THE APPALLING PASSAGE OF PROPOSITION 8</title>

      &lt;div style="clear:both;"&gt;&lt;/div&gt;&lt;div style="text-align: center;"&gt;&lt;img src="http://poplicks.com/images/straights-only.jpg" /&gt;&lt;br /&gt;Separate and Unequal&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;&lt;br /&gt;Needless to say, I am ecstatic about the presidential election and will write later about what President Obama's election means to me.&lt;br /&gt;&lt;br /&gt;But the passage of &lt;a target="_blank" href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2008/11/05/BA3B13UM63.DTL"&gt;Proposition 8&lt;/a&gt; -- along with other anti-gay initiatives in Arizona, Arkansas, and Florida -- is seriously dampening my celebration.&lt;br /&gt;&lt;br /&gt;A majority of Californian voters just granted new fundamental civil rights to egg-laying chickens while stripping fundamental civil rights away from loving gay and lesbian human beings.&lt;br /&gt;&lt;br /&gt;November 4, 2008 -- rightly heralded as a national civil rights milestone -- also marked the first time that a state has stripped away a marriage-related civil right to a discriminated minority group after initially granting it.&lt;br /&gt;&lt;br /&gt;As someone who has studied the judicial branch's handling of sexual orientation and the law, I can confidently predict that no state or federal court will get in the way of Proposition 8.&lt;br /&gt;&lt;br /&gt;Which is to say, unless California voters pass a new initiative that reinstates gay marriage, gay and lesbian Californians will never again have the right to marry.&lt;br /&gt;&lt;br /&gt;(There is a strong legal argument that the 18,000 gay marriages that took place over the last few months will remain valid, however, as the language of Prop. 8 does not include any intent to apply retroactively.)&lt;br /&gt;&lt;br /&gt;I know that Gloria Allred is &lt;a href="http://www.contracostatimes.com/california/ci_10904639"&gt;filing a lawsuit&lt;/a&gt; to stop Prop. 8, but her suit is unlikely to invalidate the initiative.    Unlike Prop. 22 in 2000, Prop. 8 amends the state constitution; thus, there's essentially no argument that Prop. 8 violates state law.&lt;br /&gt;&lt;br /&gt;Moreover, there is no viable legal argument that Prop. 8 conflicts with the U.S. Constitution or any federal law.  Sadly, not one federal court has interpreted the Equal Protection Clause to require marriage equality for gays and lesbians.  Keep in mind that under federal law, there is no right to be protected, for example, against hiring discrimination by an anti-gay employer.  It would require some seriously "activist" Supreme Court justices to read a right to gay marriage into the Constitution.&lt;br /&gt;&lt;br /&gt;Theoretically, Congress could pass a law mandating marriage equality that is intended to preempt state law.  But the chances of that happening are about the same as Sarah Palin's chances of dominating on &lt;span style="font-style: italic;"&gt;Jeopardy&lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;Thus, for now, Proposition 8 represents a nail in the coffin for full gay and lesbian equality in California.&lt;br /&gt;&lt;br /&gt;Although dispirited, I remain optimistic, however, that we will eventually see full equality again in California.&lt;br /&gt;&lt;br /&gt;This will require a new smartly-worded initiative, a better-organized movement, more money, and only an incremental shift in public opinion.  (It was close, after all.)&lt;br /&gt;&lt;br /&gt;Since we've seen the successful scare tactics of the fundamentalists' Yes on 8 campaign, any new initiative should probably make clear that places of religious worship will not be required to offer gay weddings.&lt;br /&gt;&lt;br /&gt;For those who are with me on this civil rights struggle, we have a lot of work to do.&lt;br /&gt;&lt;hr /&gt;&lt;br /&gt;(OW chimes in)&lt;br /&gt;&lt;br /&gt;Junichi, thanks for that informative - though sobering - reality check. I do want to add something here...&lt;br /&gt;&lt;br /&gt;I've noticed that some people seem to forget that &lt;a href="http://en.wikipedia.org/wiki/California_Proposition_22_%282000%29" target="_blank"&gt;Prop 22&lt;/a&gt; passed just eight years ago and, to me, it says a lot that, collectively, Prop 22 actually has been forgotten. The idea of gay marriage is prevalent enough to - on the one hand, spark a reactionary backlash as we've seen - but it's also common enough that we take its possibility for granted.&lt;br /&gt;&lt;br /&gt;The other thing worth noting is that Prop 22 passed by a massive margin: 20+ points whereas Prop 8 is going to get by on just 4 points. I don't think you can really quantify tolerance but a five fold &lt;i&gt;decrease&lt;/i&gt; in opposition to gay marriage in just eight years seems something worth thinking about.&lt;br /&gt;&lt;br /&gt;Back when Prop 22 passed, I said, despairingly, to a few friends that "gay marriage will never happen in our lifetime" and one of them chided me to pay attention to the long view and see just how far things had come, even despite that evening's results and I think it's worth thinking on this too in our moment of discouragement.&lt;br /&gt;&lt;br /&gt;The beauty of the state initiative system which is also its curse is that, in any given year, who knows what will come to the fore? And there's nothing stopping a well-organized campaign from putting the acceptance of gay marriage on next year's ballot.&lt;br /&gt;&lt;br /&gt;And the next year's ballot.&lt;br /&gt;&lt;br /&gt;And the next year's ballot.&lt;br /&gt;&lt;br /&gt;Until that 4 point spread is gone.&lt;br /&gt;&lt;br /&gt;American social justice has &lt;i&gt;never&lt;/i&gt; taken a path of linear progress. There are always set-backs and resurgent periods of reactionary behavior. But I think this issue is winnable - absolutely winnable - with better organizing and better education &lt;i&gt;especially in communities of color&lt;/i&gt;. As some of the exit polling has shown, the single-most community that came out for Prop 8 were African Americans - at 70%! - and the Latino community was also largely in favor of it too (~55-57%). Strikingly as well: the counties that voted against it, overwhelmingly, were the best educated in the state. No county where less than 10% of the population had bachelor's degrees (~20) voted against it.&lt;br /&gt;&lt;br /&gt;So there's work to be done but this is not an impossibility (least of all in a state as mercurial as California).
